can I use a concept someone else already translated in 3d a long time a go?

Great question.
Is the concept art in 2D? If so yes. However, be careful to not use the already translated into 3D as your reference. Make it your own, using the original 2D concept as your guide.

well I found the concept Yann de Preval: Photo (tumblr.com)
but found out later someone already did it ...
ArtStation - Angry Viking, Francesco Del Fuoco
and he did quite a good job. just wanna be sure it is not gonna be a problem otherwise i use another one

If you make a 3D model based on the 2D concept, and not from another 3D artists' take on it, you should be fine. If this is something you are worried about, simply choose a different concept inspiration.
